1. Delivery terms and conditions

1.1. A delivery period stated by Mitsuefu is based on the circumstances applicable to Mitsuefu at the time the Agreement is concluded and, insofar as dependent on the performance of third parties, on the information provided to Mitsuefu by those third parties. Mitsuefu will comply with the delivery term as much as possible, but this is not a strict deadline.

1.2. Upon receipt of payment of the Purchase Price, Mitsuefu will deliver the Goods ex works/warehouse. The aforementioned method of delivery can only be deviated from if expressly agreed otherwise in writing.

1.3. If Mitsuefu requires information and/or resources for the performance of the Agreement that must be provided by the Customer or fulfillment of any other obligation imposed on the Customer by the Agreement, the delivery term will not commence until the day on which all the necessary information and/or resources are in Mitsuefu's possession or the Customer has fulfilled said obligation towards Mitsuefu.

1.4. Mitsuefu is entitled to deliver sold Goods in parts. If the Goods are delivered in parts, Mitsuefu is entitled to invoice each part separately.

1.5. In the event of late delivery, the client must give Mitsuefu written notice of default, giving Mitsuefu a reasonable period to still meet its obligations.

1.6. If the delivery term is exceeded, the Customer is not entitled to any compensation in this respect. Neither is the Customer entitled to dissolve the Agreement. 

1.7. The Customer cannot refuse to accept the goods from Mitsuefu from the moment of payment for the goods and placing the order with Mitsuefu. 

1.8. The method of shipment and the means of transport shall, unless otherwise agreed, be left to the choice of the Customer. The Customer shall insure transport at his own expense and risk.

1.9. The Goods shall in any case be deemed to have been delivered after transfer to the carrier.

1.10. If the Customer does not accept the Goods or does not accept them on time, the Customer shall be in default without notice of default being required. The Customer remains liable for all amounts due under the Agreement.

1.11. The Customer is responsible for the assembly, installation and commissioning of the Goods.

2. Returns and warranty

Mitsuefu is always ready to exchange your purchase if we have shipped an incorrect or defective product, but please do not damage the packaging or remove the tags and/or protective coverings from your merchandise until you've determined that it's the right size. Failure to follow this instruction may result in additional charges and/or refusal of your return. All returned Goods must be in their original, new, unused, and unworn condition, and include their original undamaged packaging, attached tags, instructions, etc. Never ship an item in its original manufacturer's packaging, because it will arrive damaged. Please use a postal box or other packaging to save the Goods, which you're returning.

2.1. Customer must examine the Goods upon delivery. The Customer must check whether the goods delivered comply with the Agreement, i.e. in any case:

  • whether the correct Goods have been delivered;
  • whether the delivered Goods correspond in quantity and number with what has been agreed;
  • whether there is visible (transport) damage;
  • whether the delivered Goods meet the requirements that may be expected for normal use and/or trading purposes;

2.2. Complaints regarding defects in the Goods must be made to Mitsuefu in writing and detail immediately after discovery, but at the latest within ten days of delivering the Goods to the Customer.

2.3. If the term as stipulated in paragraph 2 is exceeded, any claim against Mitsuefu in respect of the defects will lapse. Legal actions in this respect must be taken within six months of the timely complaint on pain of forfeiture.

2.4 Mitsuefu is not responsible for any defects in the Goods caused by:

  • failure to comply with requirements;
  • other than normal use;
  • normal wear and tear;
  • negligence;
  • overload;
  • adjustments made by third parties;
  • an accident;
  • a cause that is not related to the Goods.

2.5. For Goods sent internationally, please take note that any manufacturer warranty may not be applicable, and manufacturer repair options may not be accessible. Product manuals, instructions, and safety warnings may not be in your country's language; the merchandise may not be made in agreement with your country's standards, specifications, and labeling requirements also. And the merchandise may not obey the guidelines of your country's voltage and other electrical standards.
